WEB-DESI PROCEDURES


 

ABOUT Web-DESI

The Department of Commerce's Bureau of Industry and Security (BIS) is pleased to offer Web Data Entry Software for Industry (Web-DESI). Web-DESI allows industry to submit Chemical Weapons Convention (CWC) declarations and reports for Schedule 1, 2, and 3 chemicals and Unscheduled Discrete Organic Chemicals via the Internet in a secure environment.

Web-DESI is a voluntary tool designed to reduce your burden in complying with CWC declaration and report requirements under the CWC Regulations (CWCR, 15 CFR Parts 710-729). Web-DESI allows you to perform the following actions:

  • Add a new declaration or report
  • Copy a previously submitted declaration or report to create a new declaration or report
  • Submit a UDOC "No Changes" Authorization
  • Amend a previously submitted declaration or report
  • View declarations or reports previously submitted by a facility, plant site, or trading company
  • Delete a declaration or report that has not yet been submitted
  • Submit completed declarations or reports
  • Submit a declaration or report by uploading an export file produced by DESI
  • Print a declaration or report   (SEE NOTE)
  • Receive same day acknowledgment of your submission

NOTE: To print declarations created in Web-DESI your computer (or local area network) must allow temporary files to be downloaded from the Internet and stored onto your computer. If you are having problems printing a declaration, contact your Computer Help Desk about your Internet security settings.

 

REQUIREMENTS

Prior to using Web-DESI, you must have:

  • Internet access, web browser with 128-bit encryption (Internet Explorer, Google Chrome, Mozilla Firefox, other browsers that support TLS secure encryption), and Adobe Acrobat Reader (free shareware).
  • Requested authorization from BIS to use Web-DESI.

You will need to complete and submit a certification letter. Detailed procedures for submitting the letter are set forth in Section 711.8 of CWCR. [ and below ]

 

DESCRIPTION

Web-DESI was created to give industry the option to submit declarations and reports for Schedule 1, 2, and 3 chemicals, and Unscheduled Discrete Organic Chemicals (UDOCs), via the Internet. You must have a valid password (USC password) for your facility, plant site or trading company as well as a user account (user name and password) to access Web-DESI. The procedures and requirements for obtaining and using these accounts are set forth in Section 711.8(b) of the CWCR.

You may obtain account passwords to access Web-DESI by sending a certification letter entitled "Electronic Declaration or Report Request", on your Company's letterhead, with the title and signature of the owner, operator or senior management official (e.g., plant/plant site manager, regulatory compliance official), to the Treaty Compliance Division, Bureau of Industry and Security (TCD/BIS). Each facility, plant site or trading company that has a USC Number must submit a separate certification letter. Each facility, plant site or trading company granted authorization to use Web-DESI will be assigned a password (USC password) that must be used in conjunction with the US Code Number. A facility, plant site or trading company shall reveal the assigned password only to the individual users, their supervisors, employees, or agents of the applicant facility, plant site or trading company with a commercial justification for knowing the password.

Each individual who will be accessing Web-DESI must have his/her own account with assigned user privileges and must have signed the "Electronic Declaration or Report Request" certification letter. There are several types of privileges that an individual may be assigned, as follows:

NOTE: The Company officer who signs the certification letter must also sign the Account Holder Certification if Web-DESI access is required.

BIS's Treaty Compliance Division (TCD) will convey account information to authorized users by telephone. Individuals may select their own user account password or BIS will assign a computer generated password.

NOTE: TCD will ensure that individuals who will have access to multiple Web-DESI accounts will only have one user password.

 

Individual User Account Holders must not:

  1. Disclose their account information to anyone except TCD/BIS (including supervisors or coworkers);
  2. Record the account number either in writing or electronically;
  3. Allow another person to use their account (including supervisors or coworkers);
  4. Use the account following termination of his/her authorization for account use by TCD/ BIS or by the applicant facility, plant site or trading company.

To prevent misuse of the Web-DESI User Account:

  1. You and the applicant facility must report the loss, theft, or compromise of an account immediately, during business hours, by calling TCD/BIS at (202) 482-1001 and confirm the report in writing within two business days; and
  2. You must immediately, during business hours, notify TCD/BIS whenever an account holder leaves employment with your facility, plant site or trading company or otherwise ceases to be authorized by your facility to view/submit declarations via the Internet on its behalf.

Internet Submissions

Upon submission of the required certifications and approval of the facility, plant site or trading company's request to use Web-DESI, TCD/BIS will provide instructions both on the method to electronically submit declarations and reports. TCD/BIS may modify these instructions from time to time.

The electronic submission of a declaration or report will constitute an official document as required under Part 711 of the CWCR. Such submissions must provide the same information as written CWC declarations or reports and are subject to the recordkeeping provisions of Part 721 of the CWCR. The facility, plant site or trading company and Web-DESI user submitting the declaration or report will be deemed to make all representations and certifications as if the submission were made in writing by the facility, plant site or trading company and signed by the owner, operator or senior management official of the company. Electronic submission of a declaration or report will be considered complete upon transmittal to BIS.

A document submitted electronically has the same legal effect as one submitted on paper and you are as accountable for the accuracy of the statements you make electronically as you are for statements made on paper.

Maintenance of Records

You shall maintain a log, either manually or electronically, specifying the date and time of each Internet submission, the declaration or report type and year of each submission, and the name of the employee or agent making the submission. This log may not be altered. Written corrections must be made in a manner that does not erase or cover original entries. If the log is maintained electronically, corrections may only be made as notations.

 

CERTIFICATION LETTER

A facility, plant site or trading company must submit a certification letter entitled, Web-DESI Certification Letter for Electronic Declaration or Report Request, on Company letterhead, with the signature of the owner, operator, or senior management official of the Company, to BIS/TCD listing the authorized users that will be accessing Web-DESI. Each facility, plant site or trading company that has a US Code must submit a separate certification letter.

THIRD PARTY ELECTRONIC SUBMISSION

BIS/TCD permits third parties to submit declarations or reports on behalf of facilities, plant sites, or trading companies, via Web-DESI. In order for a third party to be authorized to make electronic submissions to Web-DESI for a facility, plant site or trading company, it must submit a certification letter. Note that a separate certification letter is required for each facility, plant site or trading company that the Company represents.

UPDATING

An approved facility, plant site or trading company shall promptly notify TCD/BIS of any change in its Company name, ownership or address. If the facility, plant site or trading company wishes to have an individual added as a Web-DESI user, the facility, plant site or trading company shall so advise TCD/BIS and proceed in accordance with the instructions provided by TCD/BIS. The applicant facility, plant site or trading company should conduct periodic reviews to ensure that only individuals whose current responsibilities make it necessary and appropriate that they act for the applicant facility, plant site or trading company in this capacity and hold accounts.
